Webtv.lk is an on-line service (“Webtv”) operated by MTV Channels (Pvt) Ltd ("MTV") on the World Wide Web of the Internet, consisting of news, information services and content (Contents) "You / Subscriber" means each individual person who establishes or accesses a connection ("Account") for access to and use of Webtv . "We/Us" means MTV Channels (Pvt) Ltd. and it’s affiliates.
The following terms and conditions govern Subscriber use of Webtv. Violation of these terms and conditions may result in immediate cancellation of the access to Webtv and no fees paid will be refunded.
1. You are granted a nonexclusive and nontransferable access to use the services provided by Webtv. Therefore, You shall not share, assign or authorize third parties to use the username and the password which is assigned solely to You.
2. Subscriber shall be fully responsible for protecting the confidentiality of Subscriber's username and the password.
3. You shall use Webtv only for lawful purposes.
4. You ackowlege that the Webtv contains copyrigh material, trademarks and other proprietary information, including, but not limited to, text, software, photos, video, graphics, music and sound. Intellectual property rights of the Webtv are protected under the Laws.
5. Subscriber shall not modify, publish, transmit, participate in the transfer or sale, create derivative works, or in any way exploit, any of the content, in whole or in part that contain in Webtv.
6. Except as otherwise expressly permitted under law, no copying, redistribution, retransmission, publication or commercial exploitation of downloaded material will be permitted without the express permission from Us.
7. Subscriber shall not upload, post or otherwise make available on Webtv any material protected by copyright, trademark or other proprietary right without the express permission of the owner of the copyright, trademark or other proprietary right and the burden of determining that any material is not protected by copyright rests with Subscriber. Subscriber shall be solely liable for any damage resulting from any infringement of copyrights, proprietary rights, or any other harm resulting from such a submission.
8. We shall have the right to monitor the use of Webtv by the Subscriber.
9. Subscriber agrees to defend, indemnify and hold harmless MTV, its affiliates and their respective directors, officers, employees and agents from and against all claims and expenses, including attorneys' fees, arising out of the use of Webtv by Subscriber or Subscriber's Account.
10. Either Subscriber or We may terminate the subscrition at any time. Without limiting the foregoing, We shall have the right to immediately terminate Subscriber's Account in the event of any conduct by Subscriber which We, in our sole discretion, considers to be unacceptable, or in the event of any breach by Subscriber of this Terms and Conditions.
11. Subscriber expressly agrees that the use of Webtv is at Subscriber’s sole risk. Neither We, nor any of our affiliates nor any of our respective directors, officers, employees and agents warrant that Webtv is uninterrupted or error free nor do We/ any of our affiliates nor any of our respective directors, officers, employees and agents make any warranty as to the results that may be obtained from use of the Service.
12. We disclaim liability which applies to any damages or injury caused by any failure or performance, error, omission, interruption, deletion, defects, delay in operation or transmission, computer virus, communication line failure, theft or destruction or unauthorized access to, alteration of, or use or record, whether for breach of contract, tortious behavior, negligence, or under any other cause of action. Subscriber expressly agrees that Webtv or We do not liable for the defamatory, offensive or illegal conduct of other subscribers or third parties and that the risk of injury from the foregoing rests entirely with the Subscriber.
13. Subscriber shall be responsible for obtaining and maintaining all telephone, computer hardware and other required equipment for access to and use of Webtv and all charges related thereto.
14. While the Contents on Webtv contain news items and issues inter-alia, Subscriber expressly acknowledges such news items and issues are not advice for the Subscriber or for the general public. Further, We do not liable for any act You may commit based on the Contents on financial information on the Webtv.
15. We shall have the right at any time to change or modify the terms and conditions applicable to Subscriber's use of Webtv, or any part thereof, or to impose new conditions, including, but not limited to, adding fees and charges for use. Such changes, modifications, additions or deletions shall be effective immediately upon notice thereof, which may be given by means of posting on Webtv, or by electronic mail thereof. Any use of Webtv by Subscriber after such notice shall be deemed to constitute acceptance by Subscriber of such changes, modifications or additions.
